A Federal High Court in Kano has declared the Kano Emirates Council (Repeal) Law 2024, which dissolved five emirates, to be valid. However, all actions taken by Governor Abba Yusuf to execute the law have been nullified.
In his ruling on Thursday, Justice Abdullahi Liman stated that although the governor was not formally served the order, he acknowledged awareness of it. The judge criticized the governor for disregarding the order, which was publicly shared on social media.
According to the Judge, “The Defendants are aware even though it’s true that they were not served. They were aware of the order via social media. It’s wrong to disregard social media as a means of dissemination of information.
“The court will not hesitate to set aside the act done in disobedience of the order of court. They chose the line of whims and caprices and it has landed them in trouble.
“Every step taken by the defendant in execution of the law is set aside, but this does not extend to the validity of the law.
“And without prejudice to the substantive matter, the law is still the law but all actions carried out in the execution of the law are set aside”
He, thereafter, transferred the case to Justice Simon Amobeda, a colleague at the federal high court, to continue with the matter.
